  Welcome to Over The counter Services   We are pleased to be able to provide answers to common questions regarding a large number of different services that we provide. For some services, we have provided 'forms' (in .PDF format) that can be downloaded, printed, and then completed at your convenience.

  Types of Courts    
  Provincial Offences Court
701 Rossland Rd. East, Whitby
132 Church St North, Bowmanville
  • Deals with non-criminal provincial offences. For example, speeding, liquor violations, Highway Traffic Act violations, etc.
  • A trial is heard by a Justice of the Peace.
  • A bail hearing is heard by a Justice of the Peace unless the accused is charged with First Degree Murder.
Ontario Court of Justice

  • Deals with criminal charges only (federal acts and regulations such as the Criminal Code and Young Offenders Act)
  • Trials are heard by a judge only – no jury.
  • Court is administered by a Court Administrator.
  • Less serious criminal charges are dealt with in this court. Crimes that are “summary conviction offences” appear in this court because they generally involve one appearance of witnesses and less serious penalties.
  • Preliminary inquiries on more serious offences (“indictable offences”) such as murder, sexual assault and robbery are heard in this court. The judge will decide at the inquiry if there is enough evidence to go to a full trial at Superior Court of Justice. Witnesses may be called to give evidence at a preliminary inquiry.
Superior Court of Justice

33 King St West, Oshawa
  • Criminal charges (Criminal Code of Canada, Young Offenders Act)
  • A full trial of an indictable offence will be held at the Superior Court.
  • The trial can be heard by judge or by judge and jury.
  • The court is administered by a Sheriff.
  • Witnesses will be notified by subpoena when to appear and in which court location.
  • Family court matters are also heard at Superior Court because they are federally legislated under Family Orders, Divorce Act, etc.
